对于众多国际贸易和国际货运代理企业来说,收货人倒闭、目的港弃货、贸易尾款无法回收,甚至集装箱抵达非洲、中东或南美地区,货物尚未被收货人签收前就发生货物遗失、被抢等事故,都使得相关外贸和货代企业蒙受巨大经济损失。
今天,小编根据宁波海事法院近年的两个典型案例,跟广大外贸和国际货运代理企业一起通过实际案例来学习如何防范国际航运风险。
案例一:货物未证明申报 依最低标准获赔
2013年,原告义乌市堆正进出口有限公司接到一笔总额236640美元的外贸服装订单后,委托货代向被告现代商船株式会社订舱,涉案集装箱在宁波港装船运输。
货物到港后,商船会社方集卡司机向当地警方报案称,其所驾卡车连同集装箱被持械歹徒劫走。
为此,堆正公司以涉案货物在商船会社责任期间内丢失致其客商无法取得货物为由,提起诉讼,请求判令商船会社赔偿其货物损失232000美元、海运费人民币23955.43元(折合人民币约166万元)及两款延期支付违约金。
宁波海事法院经审理后,判决商船会社赔偿堆正公司货物损失1391.67美元(折合人民币约9000元)及该款相应利息,驳回堆正公司的其他诉讼请求。

法官说法
FOB贸易术语是我国外贸出口企业主要采用的外贸方式。在“走出去”战略影响下,我国中小外贸企业纷纷大力开拓新兴经济体国家市场,同时承受着外方市场诚信、安全秩序及目的港政策等多重风险。
本案的判决是价值232000美元的货物,最后只能得到千余美元赔偿,也给广大中小外贸企业敲响了警钟:出运货物时务必要求承运人签发提单并在相应单证上记载货物价值。
我国海商法规定,货物的灭失或者损坏发生于多式联运的某一运输区段的,多式联运经营人的赔偿责任和责任限额,适用调整该区段运输方式的有关法律规定。该区段运输发生于墨西哥,应适用墨西哥法律。商船会社提交了经当地公证和我国使领馆认证的法律意见书,可以作为认定承运人责任及其限额的依据。墨西哥相关法律规定,当服务使用者没有申报货物的价值,责任将被限制在每吨墨西哥联邦区现行的15天的最低工资,若不足一吨则按比例计算。
堆正公司提交的报关单显示货物价值共232000美元,与外贸订单记载货值相对应,但货物价值并未在提单复印件和墨西哥内陆运单中显示,不能证明货物价值已申报且承运人、陆运区段承运人已获知,故承运人的责任应被限制在每吨墨西哥联邦区现行的15天的最低工资。
据此,宁波海事法院根据2013年11月美元与墨西哥比索的汇率乘以提单记载的货物重量,确定商船会社的赔偿责任数额为1391.67美元(折合人民币9000多元)。

案例二:目的港无人提货 船公司索赔20余万滞箱费
2013年10月,浙江慈溪的卓力电器公司要出口一批电熨斗,委托浙江外运有限公司宁波明州分公司向马士基航运公司订舱。
马士基公司的提单显示,托运人为卓力电器,收货人为法格公司,起运港为宁波,卸货港为巴塞罗那,1个40尺集装箱,运费到付。
同年11月19日,货物到达目的港卸货,法格公司却因破产迟迟无人提货,货物在目的港产生了高额的滞箱费。
根据马士基公司在网站公布的费用标准,截至2014年10月29日,一个40尺集装箱滞箱费为30104欧元,按照当时欧元对人民币汇率1:7.6474计算,折合人民币20余万元。
马士基公司为此向宁波海事法院提起诉讼,要求卓力公司等被告支付滞箱费和运费等相关费用。
宁波海事法院判决认为,涉案货物到港后,卓力电器公司确认其于同年12月初即知晓收货人法格公司申请破产保护无法提货,虽然其随即询问原告货物退运及费用事宜未得到答复,但其作为涉案货物的托运人,理应持续关注货物在目的港现状及后续处理事宜,及时对到港货物作出处理指示,避免在目的港产生高额费用。
在本案中马士基公司对较高目的港费用的产生也存在过错。马士基公司在货物到港无人提货约3个月后才通知相关方,在托运人一直未能给出货物处理指示时,亦未采取有效减损措施,如将货物转移至仓储费用较低的仓库等,对此亦存在过错。

为此,卓力电器和外运明州分公司承担运费,折合人民币16690元;卓力电器还要支付滞箱费人民币5万元。
法官说法
受国际经济形势不振的影响,国外买方有的倒闭,有的希望通过拖延压低货价,有的货物到港时被海关查验扣留,有的买方事先发现货物有质量问题等,都会造成集装箱货物长期滞港,产生大量费用。
当前因货物长期滞留港口无人提货,航运公司向托运人索赔港口堆存费、集装箱超期使用费的纠纷呈多发态势。在审理中还发现,南亚一些国家的买方在贸易之初即存在不良企图,通过长期不提货的方法造成海关拍卖货物,以便低价收购,给国内出口方带来损失。
为此,外贸单位在与国外买方订立销售合同时,尽可能采用CIF条款并使用信用证结汇,要求签发指示提单。这些措施的好处在于,即使买方想违约不要货物,卖方也可以直接在信用证下收取货款。
当收货人不提货的情况发生时,托运人应及早采取处置措施,防止目的港费用进一步增加,必要时需早下决心通知承运人弃货。作为承运人,须及时向托运人或其货运代理人通知无人提货的情况,提示费用增加的风险并征询对货物的处理意见;如果收货方无反馈,也需依法对货物进行妥善处置,切实尽到减损义务。中美达成第一阶段经贸协议
2019年12月13日,经过中美两国经贸团队的共同努力,双方在平等和相互尊重原则的基础上,就中美第一阶段经贸协议文本达成一致。美方将履行分阶段取消对华产品加征关税的相关承诺,实现加征关税由升到降的转变。

美国时间12月13日,美贸易代表办公室(USTR)公布了双方第一阶段经贸协议的声明:
1、美国将对约2500亿美元的中国进口商品从25%加至30%的计划取消,保持25%的关税;
2、对约1200亿美元(即9月1日已开始加征的3000亿 List 4A清单内)的中国进口商品加征的关税由原15%降至7.5%;

2019年10月10日下午6时10分,江苏省无锡市锡山区312国道K135(上海方向)发生高架桥垮塌事故,已经造成压在桥下的3辆私家车中的3人死亡,2人受伤。通过这一血淋淋的代价,为国内公路运输以及城市平安和谐发展敲响警钟。
此次悲剧如同催化剂一般,掀起全国卡车限重潮。
12月16日开始在全国范围实施高速公路入口称重新规;货车按车(轴)型收费,仍将按原计划于2020年1月1日起实施。自此,史上最严新规诞生。
新规不仅对超重将进行劝返,对于超高超长在内的“超限”,一旦在高速入口被自动称重设备发现,也将不能上公司,面临“无路可走”和退运的风险!另外,如果货车超载超限的次数达到三次,并且违法没有去处理,会被记录到黑名单,也就无法在省内高速上道路行驶。

海关新一代查验系统上线!
11月30日8点30分,新一代海关查验系统【查四系统】正式上线。该系统上线后,洋山、外港的海关查验的流程出现了重大变化。
新的流程要求:
1. 出口尽量提前申报,特别出口拼箱,新系统既按票布控,也按箱布控,就是拼箱一票查验有问题,整个箱子都走不掉。
2. 新海关查验=原海关查验+原国检查验。
原商检查验,国检的部分归入新海关查验,原商检目的地查验的项目,依旧到目的地查验。又有国检又有目的的查验的,需在港区做好国检查验,放行后,再到目的地进行目的地检验。
3. 进口方面,原先是先海关放行再动检,现在是如有动检的货物视为海关查验,先查验后放行,会导致送货时间往后延长(具体时间要等实施后才知道),港区费用和滞箱费会增加!
4. 关于新系统删改单:自11月30日起,通关科海关不再布控查验,布控的工作全部转至物控二科处理,具体操作流程由海关内部流转完成,所以会比原先的操作模式时间上更长。
5. 11月30日起,洋山事前改单的先改后查、先查后删的,由于系统升级后海关无法布控,将全部转至风险布控科逐级审批海关内部流转时间会加长。因此,该类单证洋山箱子切记不要上岛进港。

海关调整预报舱单规定
为简化数据填制要求,保证数据准确,确保海关业务改革顺利推进,加强海关对水运和空运进出境舱单管理,有效实施安全准入和风险防控机制,中国海关总署公告 2019 年第 144号调整了预报舱单的规定,此公告自 2019 年 11 月 15 日起施行。
规定概况如下:
自2019年11月15日起,出口/转口中国大陆必须在装船前 24 小时以内,提交完整、准确的舱单数据,对超过时限传输舱单电子数据或传输的电子数据不准确的物流企业,予以警告,可以处5万元以下罚款。同时,发货人代码、收货人代码、收货人具体联系人名称、收货人具体联系人联系号码、通知人代码等数据项从舱单中删除。

今年各大船公司终于按捺不住了,纷纷上岸,盯上了货代这碗饭!
继达飞轮船花费17亿美金将基华物流(Ceva Logistics)全部纳入麾下后。6月马士基全球CEO施索仁在接受华尔街日报采访时表示,希望在2年左右的时间内,内陆运输与海上运输的营收占比能达到约50%对50%。

英国分手大戏落幕,进入脱欧过渡期
综合英国广播公司(BBC)、美联社12月27日报道,根据目前安排,英国将于明年1月31日正式“脱欧”,英欧关系随后进入过渡期,暂时维持现状,以便双方就“脱欧”后全面贸易关系达成协议。过渡期定于明年(2020年)12月31日结束。

After hearing the case, ningbo maritime court decided that the merchant shipping company should compensate duzheng company for the cargo loss of usd 1391.67 (equivalent to about RMB 9000) and the corresponding interest, and rejected other claims of duzheng company.
The judge said
FOB trade term is the main way of foreign trade adopted by China's export enterprises. Under the influence of "going global" strategy, China's small and medium-sized foreign trade enterprises have made great efforts to explore the markets of emerging economies, and at the same time bear multiple risks such as foreign market integrity, security order and port of destination policy.
This case of judgment is the value of 232,000 dollars of goods, finally can only get more than a thousand dollars of compensation, but also to the vast number of small and medium-sized foreign trade enterprises sounded the alarm: when shipping goods must ask the carrier to issue a bill of lading and record the value of goods on the corresponding documents.
According to the maritime law of our country, if the loss or damage of goods occurs in a certain section of the multimodal transport, the liability of the multimodal transport operator for compensation and the limitation of liability shall be governed by the relevant laws regulating the mode of transport in that section. Case 2: the unmanned cargo ship company of the port of destination claims for more than 200,000 yuan of demurrage

According to the cost standard published by maersk on its website, as of October 29, 2014, the detention charge for a 40-foot container was 30,104 euros, which is equivalent to more than 200,000 yuan according to the exchange rate of 1:7.6474 euros to RMB at that time.
For this reason, maersk company filed a lawsuit to ningbo maritime court, requiring zhuoli company and other defendants to pay fees and freight.

In this case, maersk is also at fault for the generation of higher port charges. Maersk was also at fault for not notifying the relevant parties about 3 months after the goods arrived at the port unattended and for not taking effective mitigation measures, such as transferring the goods to a warehouse with lower storage costs, when the shipper had been unable to give instructions on the handling of the goods.
For this purpose, zhuoli electric appliance and the branch of exportation mingzhou shall bear the freight, equivalent to 16,690 yuan; Zhuoli also has to pay a case detention fee of 50,000 yuan.
The judge said
Affected by the sluggish international economic situation, some foreign buyers go bankrupt, some hope to hold down the price of goods through delay, some goods are inspected and detained by the customs when they arrive at the port, and some buyers find the goods have quality problems in advance, which will cause the container goods to delay the port for a long time and generate a large amount of fees.
At present, because the goods have been detained in the port for a long time and nobody takes delivery of the goods, the shipping companies claim for the port storage fee and the overdue container usage fee from the shipper. In the trial, it was also found that the buyers of some south Asian countries had a bad intention at the beginning of the trade to cause the goods to be auctioned by the customs through the method of not picking up the goods for a long time, so as to acquire the goods at a low price and bring losses to the domestic exporters.
For this reason, foreign trade units in the conclusion of the sales contract with foreign buyers, as far as possible to use CIF terms and the use of l/c settlement, the issuance of an order bill of lading. The advantage of these measures is that even if the buyer wants to default on the goods, the seller can collect the payment directly under the letter of credit.
When the consignee does not pick up the goods, the shipper should take early disposal measures to prevent the port of destination cost further increase, if necessary, the early determination to inform the carrier to abandon the goods. As a carrier, it shall promptly notify the shipper or his freight forwarder of the condition of the unmanned delivery of goods, alert the shipper or his freight forwarder of the increased risk of charges and seek advice on the handling of the goods; If there is no feedback from the receiving party, the goods shall be properly disposed of in accordance with the law to fulfill the obligation of impairment. Customs adjusts forecast manifest requirement
To simplify the data fill the requirements, guarantee the accuracy of the data, make sure that the customs smoothly business reform, strengthen the management of customs for shipping and air transportation of inbound and outbound manifest, effective security access and risk control mechanism, China's General Administration of Customs announcement no. 144 in 2019 to adjust the forecast manifest regulation, this announcement shall enter into force as of November 15, 2019.
The provisions are summarized as follows:
From November 15, 2019, export/re-export to the Chinese mainland must submit complete and accurate manifest data within 24 hours before shipment.
